General conditions of the lease contract
Subject matter
The subject matter of this contract is the lease of a vehicle which is concluded between the company VIZIT TURIZEM d.o.o. (hereinafter 'the lessor') and the lessee.
Price
The price of the lease is evident from the contract and is consistent with the price list or with the agreement between both contracting parties. The price does not include fuel costs. All additional costs, which can occur as a result of an accident or a traffic fine, are covered by the lessee. The price for motorcycle rental includes one homologated safety helmet. In the event of loss of the safety helmet, the lessee is obliged to cover expenses in the amount of €80.
Collection and return of the vehicle
The collection and return time are stated in the contract. They are determined with a written or a verbal agreement. Upon collecting the vehicle, the payer, the driver, or the driver’s representative signs the lease contract. We reserve the right to levy the cost of a day lease and transportation costs on an unannounced late return of the vehicle. It is forbidden to cross the borders of the Republic of Slovenia with the vehicle, unless a different written agreement was reached with the lessor.
Duties of the lessee
The lessee shall undertake to only use the vehicle for personal purposes, but in no case for illegal activities. The lessee and other users of the vehicle are prohibited to use the vehicle in a negligent or careless way. The lessee will also undertake not to operate the vehicle under the influence of substances which decrease psychomotor abilities (pharmaceuticals, drugs, alcohol, etc.). The driver is subject to full criminal and material liability for all incurred costs. The lessee vouches with their signature that they are familiar with the road traffic regulations in the Republic of Slovenia and that they will be considerate towards other road users. The lessee must possess a valid category B driving license for driving two-wheel vehicles with a cylinder capacity of up to 50 cubic centimeters and a valid category A driving license for driving motorcycles with a cylinder capacity of over 50 cubic centimeters or a specific valid license for any other vehicles in the agreement. The lessee must have health insurance recognized in the Republic of Slovenia.
Insurance
The vehicle has compulsory and comprehensive insurance. In case of any accidents, the lessee must inform the lessor and, if there are injured persons or third parties are involved, the competent authorities. If necessary, the lessee should fill out the European Accident Statement form and other documents accordingly. In the event of any superficial damages which are smaller in diameter than a €2 coin, the lessee is not obliged to cover any expenses to the lessor. The lessee will be obliged to pay €30 for superficial damages with a diameter of up to 10 centimeters. Should the vehicle suffer damages with a diameter over 10 centimeters, cracks, larger damages, or broken-off parts, the expenses will be calculated according to official price list of the importer of spare parts in the Republic of Slovenia or will be determined by an agreement. In case of theft or damages where a repair is not economically feasible, the lessee must cover the full amount of deposit.
Maintenance
The lessee will that the vehicle’s roadworthiness and shall see to it that all potential defects due to negligent handling are prevented. The lessee must monitor the state of the vehicle and maintain all fluids and other important functions of the vehicle accordingly. If a malfunction should occur, the lessee will notify the lessor immediately. It is prohibited to service, repair, overhaul, and exchange any parts on the vehicle without the prior authorization of the lessor.
Use
The lessee uses the vehicle on his sole responsibility. The lessor is not obliged to cover any expenses incurred during the time of the lease as a result of vehicle malfunction, accident, or any other factors. The vehicle may only be used under the legal provisions of the Republic of Slovenia. The vehicle must under no circumstance be involved in a competition event, testing event, or be driven on a racing ground.
All disputes come under the jurisdiction of the district court in Ljubljana.
